  • Systemic failures caused Louisville Metro Department of Corrections to detain inmates and arrestees after courts required their release. The Plaintiffs in this action brought constitutional claims on behalf of themselves and other people who were over-detained.

  • To qualify for the Class, (1) your over-detention must have occurred between February 3, 2016 and September 22, 2024, and

    (2) (a) You were detained 4 or more house past your scheduled release time; OR (b) you were detained 12 or more hours after a court ordered your release or you paid bail.

  • The parties have agreed on a settlement pool of $20 million. This fund will be used to compensate class members, administer the claims, and pay the attorneys.

    Because the length of over-detentions range from a few hours to several months, awards will vary based on how long you were deprived of your right to be free.

  • The payment structure has not yet been established. The parties are actively working to establish a detailed payment program. Updates will be posted to this site and circulated to various media outlets.

  • Auditors are currently compiling a list of individuals who are believed to qualify as Class Members. Notices of your eligibility will be sent to the most recent contact address in LMDC’s system.
